Terms of Service

1. Agreement to Terms

By accessing or using Hirvex (“the Service”), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

Hirvex is a product of Maral Amiree IT Services Afghanistan and Maral Amiree LLC USA. These Terms constitute a legally binding agreement between you and Maral Amiree IT Services.

2. Definitions

• “Service” refers to the Hirvex AI-powered hiring platform and related services.
• “User,” “you,” or “your” refers to the individual or entity accessing or using the Service.
• “Company,” “we,” “us,” or “our” refers to Maral Amiree IT Services Afghanistan and Maral Amiree LLC USA.
• “Candidate Data” refers to personal information of job applicants collected through the Service.
• “Content” refers to all information, data, text, software, graphics, and other materials submitted to or generated by the Service.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activities that occur under your account

4. Subscription and Payment

4.1 Billing

Certain features of the Service require a paid subscription. You agree to pay all fees associated with your subscription plan. All fees are exclusive of taxes, which you are responsible for paying.

4.2 Free Trial

We may offer a free trial period for new users. At the end of the trial period, you will be automatically charged unless you cancel your subscription before the trial ends.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial months.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Submit false or misleading information about candidates or jobs
• Discriminate against candidates based on protected characteristics
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Collect or harvest personal information of candidates without proper authorization
• Use the Service for any illegal or unauthorized purpose
• Reverse engineer, decompile, or attempt to extract source code from the Service

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in the Privacy Policy.

As a user, you are responsible for:

• Obtaining proper consent from candidates before submitting their data
• Complying with all applicable data protection laws in your jurisdiction
• Ensuring your use of candidate data complies with applicable employment laws
• Notifying candidates about your privacy practices

7. AI Features and Limitations

Hirvex uses artificial intelligence to assist with candidate matching, screening, and hiring decisions. You acknowledge that:

• AI recommendations are suggestions only and should not be the sole basis for hiring decisions
• AI systems may contain biases or errors
• You are solely responsible for final hiring decisions
• We do not guarantee the accuracy or completeness of AI-generated insights
• You should verify all information before making employment decisions

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Maral Amiree IT Services and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a license to use, modify, and display that content solely for the purpose of providing the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Maral Amiree IT Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Hiring decisions made using the Service
• Errors or inaccuracies in AI recommendations
• Any third-party content or conduct
• Unauthorized access to or use of our servers and personal information

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Maral Amiree IT Services, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Afghanistan and the United States, without regard to their conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kabul, Afghanistan, or as otherwise determined based on the nature of the dispute.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
